Terms of Service

1. Agreement

By using Pnyx AI's services — including the API, website, leaderboard, and evaluation tools (the “Service”) — you agree to these terms. If you're using the Service on behalf of an organization, you represent that you have the authority to bind that organization.

2. Alpha Status

Pnyx AI is in private alpha. The Service is provided as-is. Features, APIs, and functionality may change without notice. Alpha access is by invitation and may be revoked at any time.

3. The Service

Pnyx AI is an evaluation and routing platform that analyzes AI workloads and routes requests to the best-fit model based on capability and cost. The Service evaluates prompts using our A-VERT methodology, routes requests across providers (OpenAI, Anthropic, Google, and others), and publishes aggregate model performance data on a public leaderboard.

4. Your Account

You must provide accurate information when registering. You are responsible for maintaining the confidentiality of your API keys and for all activity under your account. Never share API keys or commit them to public repositories. We may revoke compromised keys without notice.

5. Acceptable Use

You agree not to:

• → Violate any applicable laws or third-party rights
• → Generate harmful, abusive, or infringing content
• → Bypass rate limits, access restrictions, or security measures
• → Reverse engineer or extract source code from the Service
• → Use the Service to develop directly competing products without written permission
• → Manipulate leaderboard rankings or performance metrics
• → Use the Service for spam, phishing, or malware

Violation may result in immediate termination of access.

6. Usage and Rate Limits

Rate limits apply per API key. Limits may change during the alpha phase. Excessive usage that impacts availability for others may be throttled. Commercial use during alpha requires explicit approval — contact [email protected].

7. Content and Intellectual Property

Your Content

You retain all rights to prompts and inputs you submit. You grant us a limited license to process your content solely for providing the Service. You are responsible for your content and its consequences.

Our Service

Pnyx AI — including our name, logo, routing algorithms, evaluation methodology, and platform features — is our intellectual property. Open-source components we release are licensed under their respective licenses.

AI-Generated Outputs

You own the outputs generated through the Service. We make no claims to AI-generated outputs. However, AI providers may have their own terms regarding outputs. AI outputs may contain errors — always verify before relying on them.

Leaderboard Data

Performance metrics and rankings are owned by Pnyx AI. You may reference them with attribution. You may not scrape or republish leaderboard data without permission.

8. Privacy

Your use of the Service is governed by our Privacy Policy. We do not store the content of your prompts or AI responses. We collect metadata for routing, performance analysis, and service improvement. Your prompts are sent to third-party AI providers to generate responses.

9. Third-Party Providers

The Service routes requests to third-party AI providers. You agree to comply with each provider's terms. We are not responsible for provider availability, performance, or content policies.

10. Fees

During alpha, the Service is free. Pricing for general availability will be announced with at least 30 days notice. Alpha users may receive preferential pricing.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING FITNESS FOR PURPOSE, ACCURACY, AVAILABILITY, AND SECURITY.

AI models may produce outputs that are factually incorrect, biased, or harmful. Routing decisions are based on heuristics and may not always select the optimal model. Leaderboard rankings reflect our evaluation methodology and may not match your specific use case. Always verify AI-generated content before relying on it.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PNYX AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

Total liability for all claims shall not exceed the greater of $100 USD or the amount you paid us in the 12 months preceding the event. We are not responsible for the actions, availability, or content policies of third-party AI providers. Some jurisdictions do not allow these limitations, so they may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Pnyx AI from any claims, losses, or expenses arising from your use of the Service, violation of these terms, violation of any law or third-party rights, your content, or your use of AI-generated outputs. This obligation survives termination.

14. Termination

We may suspend or terminate access at any time for breach, abuse, inactivity, or at our discretion during the alpha phase. You may stop using the Service at any time. To request account deletion, contact [email protected]. Upon termination, API keys are revoked and account data is deleted per our Privacy Policy.

15. Changes to the Service

We may modify, suspend, or discontinue the Service at any time. During alpha, changes may occur without advance notice. Material changes to these terms will be announced via email.

16. Governing Law

These terms are governed by the laws of the State of Delaware, USA. You agree to the jurisdiction of Delaware state and federal courts. Before filing a legal claim, you agree to contact us to attempt informal resolution. For disputes that cannot be resolved informally, both parties agree to binding arbitration under the American Arbitration Association rules. You waive any right to participate in class actions.

17. General

These terms and our Privacy Policy constitute the entire agreement. If any provision is found invalid, the rest remains in effect. Our failure to enforce any provision is not a waiver. You may not assign these terms without our consent. Nothing in these terms creates a partnership or employment relationship. You agree to comply with all applicable export laws.
